1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Holomix, Inc. ("Kairos", "we", "us", or "our") governing your access to and use of hikairos.app (the "Website"). By using the Website, you agree to these Terms. If you do not agree, please do not use it.
2. Company information
Holomix, Inc. is a Delaware corporation. The Website is operated for Kairos and is accessible at https://hikairos.app. Questions about the Website may be sent to [email protected].
3. Pre-launch information
Kairos is in pre-launch. The Website describes a product under development and may include conceptual or illustrative material. No public Kairos API, provider connection, payment rail, browser workflow, webhook, or transaction service is offered through the Website unless we expressly state otherwise.
Joining the waitlist does not create an account, purchase, subscription, service agreement, or obligation for either you or Kairos. We may change, pause, or discontinue the waitlist at any time.
4. Acceptable use
You may use the Website only for lawful purposes. You may not:
- Use the Website to violate applicable law or another person's rights.
- Submit information that is false, misleading, or unlawful.
- Interfere with the Website, its security, or its availability.
- Upload or transmit malware, harmful code, or abusive content.
- Scrape, crawl, or access the Website in a way that bypasses technical controls or imposes unreasonable load.
- Attempt to impersonate Kairos, Holomix, Inc., or another person or organization.
5. Waitlist communications
If you provide an email address for early-access updates, you represent that you are authorized to provide it. We may use it to send the updates you requested and to administer the waitlist. You may unsubscribe or ask us to remove it by contacting [email protected].
6. Intellectual property
The Website, including its original text, design, software, branding, and other materials, is owned by Holomix, Inc. or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Website for its intended purpose. No other rights are granted.
7. Third-party materials and links
The Website may identify or link to third-party services and brands. Those names, logos, and materials belong to their respective owners. Third-party links are provided for convenience; we do not control or endorse third-party services and are not responsible for their content, availability, or practices.
8. User messages
If you send us a message or other material, you are responsible for its content and for having the rights needed to share it. You grant us permission to use it as reasonably necessary to respond, provide support, protect the Website, and improve our services. Do not send confidential information unless we request it through an appropriate channel.

10. Disclaimers
THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. KAIROS DISCLAIMS WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETE, OR THAT PRE-LAUNCH INFORMATION WILL REMAIN CURRENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Holomix, Inc. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE WEBSITE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE WEBSITE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE WEBSITE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of this section may not apply to you.

We may update these Terms by posting a revised version on this page. The revised Terms take effect when posted unless stated otherwise. We may suspend or terminate access to the Website if we reasonably believe it is necessary to protect the Website, users, or our rights.
14. General terms
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement about your use of the Website.
